The Morgan County News has obtained a copy of the police report of the accident of Morgan County Deputy Nikkole Malan that occurred in the early morning hours of Sunday, October 10, 2010 on Old Highway Road near the Cottonwood area of Mountain Green.
Malan was cited for driving under the influence (DUI), leaving the scene of an injury accident, unsafe lane travel, expired registration, carrying a concealed weapon while intoxicated, and open container.
Malan is a Deputy Sheriff in Morgan County and has previously been the DARE officer in the county. Since Malan is a Deputy in the County, when Morgan deputies arrived at the scene of the accident, they called the Utah Highway Patrol to investigate. This is normal procedure to avoid any conflict of interest the Sheriff’s office may have when investigating one of their own officers. According to Morgan County Sheriff Gene Ercanbrack, when the Utah Highway Patrol officer arrived, the UHP officer was also acquainted with Malan and made the decision to request that the incident be investigated by the Weber County Sheriff’s Office.
The Weber County Deputy that was dispatched to the scene is the deputy that cited Malan with the offenses listed above. Malan was taken to a local hospital where she was treated for her injuries and was given a blood test. The Weber County Attorneys office reported that it will take four to nine weeks to receive the results of the blood tests. Malan continues to be on unpaid administrative leave while the investigation continues.
